GEM supports the importance of informational privacy of individuals’ personal and/or sensitive information. This extends to the collection and management of information held in its records regarding individuals
GEM cares about you our customers and users of the Website and GEM App (“User”, “You”, “Your”, “They ”, “Their”) and any concerns you may have about the safety and use of the Personal Information you provide to GEM.
In this Privacy Policy:
a. “GEM App” or “App” means the web app, web application, mobile application, app and any other like software utilised by GEM from time to time;
b. “Website” or “Site” means the internet website www.thegem.com, and all its pages (excluding third party pages and sites);
GEM operates the GEM Rewards Program, GEM App and the Website under grant of licence from Giving Even More Holdings Pty Ltd (GEM Holdings) for the use of all intellectual property, assets, data and database and entitlements contained therein (or accessed therefrom), and by engaging with GEM, you agree that this Cookies Policy are at all times subject to the condition of the such licence and that all aforementioned rights to data exchanged through the GEM App and Website are owned by and retained by GEM Holdings. You acknowledge and accept that GEM Holdings is entitled to be assigned or novated all GEM’s rights, entitlements and obligations under this Cookies Policy. To the fullest extent permitted in law (including as a deed poll by you), you agree and acknowledge that GEM Holdings is vested and granted all rights, entitlements benefit held by GEM in this agreement and in connection with all terms, conditions, covenants or authorisations provided herein, notwithstanding that GEM Holdings is not a party to the agreement. You agree that GEM Holding may exercise all rights and entitlements under this agreement, on its own behalf or on behalf of GEM at its discretion.

The following sets out GEM’s Cookie Policy (“Cookies Policy”).
COOKIES:
1 WHAT IS A COOKIE?
A cookie is a small amount of data generated by a website and saved by your web browser. Its purpose is to remember information about you, similar to a preference file created by a software application.

3. WHY DOES GEM USE COOKIES?

5. WILL ANYONE ELSE USE COOKIES ON GEM’S SITE?
Yes. Companies and partners engaged by GEM may use Cookies on the GEM website and App to gather knowledge and data on how the App is used and to identify any issues which may arise and to record user usage information so that we can provide an excellent user experience.

You can disable the cookies that we attach, if your browser supports this. For further information on how to do this please visit your browser “Settings” and follow the information.

7. IDENTIFIERS
When you use mobile devices such as tablets or smartphones to access our GEM App we may access your device, monitor your search content, collect and/or remotely store one or more “device identifiers.”
8. WHAT IS A DEVICE IDENTIFIER?
Small data files or data structures stored on or associated with your mobile device. These uniquely identify your mobile device. An identifier might be data stored in the devices hardware, data stored in connection with the devices operating system or other software or data that GEM has sent to your specific device.
Various identifiers including advertising identifiers, unique application identifiers, unique device Identifiers.
What the identifier will do is send this information it has gathered to GEM, GEM’s associated company GEM Holdings or third party associates providing us or them with information on how you browse our Website or GEM App and content you have looked at or services you use so we can provide you with advertisements or content relevant to your search history.
9 WEB ANALYTICS
GEM uses Google Analytics, a web analysis service provided by Google Inc (“Google”). Google Analytics uses cookies to help our Website analyse how visitors use it. The information generated by the cookie about your use of our Website (including your IP address) will be transmitted to and stored by Google on servers in the United States or service locations as used by Google.
Google will use this information for the purpose of evaluating your use of the GEM Website; compiling reports on activity for our operators to support the provision of other services related to internet usage. Google may also transfer this information to third parties where required to do so by law or where such third parties process information on Google’s behalf.

By using GEM on your mobile device or computer, you consent to the processing of data about you by Google in the manner described in Google’s privacy policy and for the purposes set out above. You can opt out of Google Analytics, if you disable or refuse the Cookie, disable Java Script or use the Opt Out Service provided by Google.
GEM also has its own analytics tools that it uses to gather information such as:
· Access times of when you have been using GEM and on what device.
· What pages you have visited, videos you have watched or advertisements viewed for example.
· Your IP address.
· How you are using our services.
· Device Information including what operating system or web browser type you are using.
- Language.
· App crash reporting.
· Identifiers associated with cookies or other technologies that identify your device or browser information.
· Pages you visit, advertisements you watch, websites you visit.
The analytics information referred to above will also be accessed by the GEM associated entities such as GEM Holdings being our marketing company. By accepting the GEM Cookies Policy and our Website and General Terms and Conditions you are agreeing and acknowledging that you understand the above.
GEM reserves its rights to substitute third party analytics providers and will advise you should we do so.

Because we want your experience of our site to be as informative and useful as possible, we may provide links to websites operated by third parties (“Third Party Websites”).
